Terms & Conditions
These Terms and Conditions govern access to and use of the real estate crowdfunding digital platform operated by Novumdigitalio S.A.S. (NIT 901.456.789-2), domiciled at Carrera 7 #71-52, Torre B, Office 1201, Bogotá D.C., Colombia. By accessing or using the platform, you accept these terms in their entirety.
1. Definitions
• Platform: The website novumdigitalio.com and all associated digital services.
• User: Any natural or legal person who accesses the platform.
• Investor: A registered user who participates in real estate crowdfunding projects.
• Project: A real estate development published on the platform to receive collective financing.
• Developer: A natural or legal person responsible for the execution of the real estate project.
2. Nature of the Service
Novumdigitalio operates as a technological intermediary connecting investors with real estate construction and development projects in Colombia. The platform facilitates the collective investment process in accordance with the regulatory framework established by Decree 1357 of 2018 and its subsequent amendments.
Novumdigitalio does not act as a financial institution, trust company, or investment fund manager. We do not guarantee returns or the recovery of invested capital.
3. Registration Requirements
To participate as an investor, you must:
• Be of legal age under Colombian law (18 years).
• Provide truthful, complete, and up-to-date information.
• Complete the identity verification (KYC) and anti-money laundering (AML) process.
• Accept these Terms and Conditions, the Privacy Policy, and the Cookie Policy.
• Declare that the funds used for investment come from lawful sources.
4. Investments and Risks
Investments made through the platform are subject to risks inherent to the Colombian real estate market, including but not limited to:
• Market risk: fluctuations in real estate property values.
• Liquidity risk: investments may not be easily convertible to cash before the established deadline.
• Construction risk: delays, cost overruns, or non-compliance by the developer.
• Regulatory risk: changes in regulations that may affect investment conditions.
• Risk of total or partial loss of invested capital.
5. Intellectual Property
All content on the platform, including texts, graphics, logos, images, software, designs, and trademarks, is the exclusive property of Novumdigitalio S.A.S. or its licensors and is protected by Colombian intellectual property laws and international treaties.
6. Limitation of Liability
Novumdigitalio shall not be liable for:
• Losses arising from investment decisions made by users.
• Temporary service interruptions due to maintenance, updates, or force majeure.
• Acts or omissions of real estate developers in the execution of projects.
• Indirect, incidental, or consequential damages arising from the use of the platform.
7. Dispute Resolution
Any dispute arising from these Terms and Conditions shall be resolved in accordance with Colombian law. The parties agree to submit to the courts of Bogotá D.C., Colombia, as the competent jurisdiction.
8. Modifications
Novumdigitalio reserves the right to modify these Terms and Conditions at any time. Modifications will take effect thirty (30) calendar days after publication on the platform.
